The Treasury Department has ordered the Revenue Department to investigate the taxes of ‘ Boss The Icon ‘ . The NESDB has accepted the request and set up a team to discuss with several agencies to amend the pyramid scheme and fraud laws.
Mr. Chulaphan Amornvivat, Deputy Minister of Finance, said that the Prime Minister ordered many agencies to jointly solve the problem, including the Consumer Protection Board, the Royal Thai Police, and the Ministry of Finance. Therefore, they have accepted the policy to study the approach to solve the pyramid scheme and fraud laws because they have been enforced for a long time since the Mae Chomoi case. As for the Revenue Department, they have inspected the tax filing and payment of both companies and individuals. ‘Boss The Icon’ found that some people did not file their tax forms, so they have to look at how to pay back taxes according to the steps, including whether the forms were completely and correctly filed.
The bank has now been summoned to submit financial informa
tion of all individuals involved in ‘Boss The Icon’ and has been summoned to investigate the tax payments of both corporations and individuals. If the main agency responsible for the case coordinates to request information, the Treasury is ready to cooperate in all aspects.
Mr. Pornchai Thiravet, spokesman for the Ministry of Finance, said that it must be considered whether ‘Boss The Icon’ involved falls under the conditions of fraud and pyramid scheme laws. It must look at the elements of the offense under the Emergency Decree on Borrowing Money That is Fraudulent to the Public. It must fall under all 3 offenses, not just one: 1. There must be a financial signing with a group of people. 2. Providing returns higher than the legal interest rate. 3. Doing activities that do not actually produce, similar to manufacturing goods in a general factory. It only takes the members’ registration money to pay as returns to other members, circulating for many rounds.
Therefore, the NESDB, the investigators, and related
agencies must seek evidence and facts in all aspects to find a conclusion on how Boss The Icon committed all 3 offenses. Therefore, we must continue the investigation, collect data, documents, evidence, and witnesses in all aspects. The NESDB is willing to cooperate with the police. The government has already given a policy for the Ministry of Finance to go back and study how to amend the law on the Emergency Decree on Fraudulent Loans to the Public in order to take swift action.
The Ministry of Finance, through the NESDB, has set up a legal team to discuss with relevant agencies such as the Council of State, the Ministry of Justice, the Department of Justice, and the Royal Thai Police to discuss and jointly consider which laws should be amended in order to present them to the government for consideration in the next step.
