Secretary-General of the Council of State Discusses Possible Revocation of MOU 44

Bangkok: The Secretary-General of the Council of State has indicated that the revocation of MOU 44 is feasible, provided it does not breach international law. The Ministry of Foreign Affairs is currently awaiting further study on the specifics of this matter.

According to Thai News Agency, Mr. Pakorn Nilapraphan, the Secretary-General of the Council of State, addressed the directive from Prime Minister Anutin Charnvirakul to explore the feasibility of canceling the 2001 Memorandum of Understanding (MOU). The Ministry of Foreign Affairs has been assigned the task of reviewing the MOU's details, which includes an assessment of international law and the terms and conditions of the original agreement to ascertain potential courses of action.

The cancellation of the MOU is possible in principle, but it must adhere to established procedures and conditions. This involves evaluating whether a new framework agreement or set of rules is necessary if the MOU is annulled. Such a decision requires mutual consent between Thailand and Cambodia. Should both nations agree to "start anew," the process can proceed through legal and diplomatic channels.

On a related legal matter concerning the possibility of ballot papers with QR codes invalidating an election, Mr. Pakorn stated that if the issue has been submitted to the court, a ruling should be awaited. He emphasized that offering opinions outside the legal process could lead to unproductive conflicting interpretations.
