Supreme Court Prepares to Tackle Parliamentary Election Petitions

Bangkok: The Supreme Court is ready to consider petitions regarding the parliamentary election. The Election Division of the Supreme Court is prepared to receive and examine petitions related to the parliamentary elections across the nation. Provincial courts will handle petitions concerning constituency Members of Parliament (MPs), while those regarding party-list MPs will be filed directly with the Supreme Court at Sanam Luang.

According to Thai News Agency, Mr. Suriyan Hongvilai, spokesman for the Judiciary, discussed the preparations for election cases, noting the readiness of the Election Cases Division of the Supreme Court to consider and rule on petitions and requests associated with election laws. Following the announcement of the Royal Decree dissolving the House of Representatives in 2025 to hold a new general election, the Election Commission will issue a Royal Decree setting the election date and announce the registration period for constituency and party-list MPs. The judiciary will commence its work on the day of registration for MPs nationwide, addressing potential disputes over eligibility, such as rejected applications, unannounced candidate lists, or removed names.

For candidates running under the constituency system, the Election Cases Division of the Supreme Court has designated provincial courts, including those in districts countrywide, to receive and investigate petitions. The investigation results are sent via a specially designed online system of the Supreme Court to the Election Cases Division for consideration and order issuance. This order is then returned to the respective court to be read aloud to the involved parties.

Candidates on the party-list system can have opposing parties file petitions directly at the Election Cases Division of the Supreme Court, located in the Supreme Court building at Sanam Luang, Bangkok. The Election Cases Division will then investigate and consider these petitions.
