Mr. Surawong Thienthong, MP for Sa Kaeo and Secretary-General of the Pheu Thai Party, spoke about the case in which the opinion of the Secretary-General of the Council of State was cited that if Mr. Chan Phuangphet, the President of the Pathum Thani Provincial Administrative Organization, started working, he must stop performing his duties. In Mr. Chan’s case, it was an exercise of power according to the law on local government elections, which is a general case. The case is under the jurisdiction of the court. The court should be the one to order. If the Ministry of Interior orders a stoppage of duties, it is considered an administrative order. The person who was ordered can file a lawsuit with the Administrative Court.
The Pheu Thai Party Secretary also said that for the previous case of Mr. Chan, the Pheu
Thai Party’s legal team has already investigated the information on the matter and is of the opinion that the NACC is the plaintiff in this case. At the time the court accepted the case, Mr. Chan did not have a position, so there was no reason to suspend him from performing his duties. The case is under the jurisdiction of the court. If he needs to be suspended from performing his duties, the NACC, which is the plaintiff, must file a petition with the court.
‘Whether to suspend or not to perform duties is not stipulated in the Criminal Court Procedure Act. It is only written in the Organic Act on the NACC. It is the court’s discretion whether to suspend or not to perform duties. It is not an automatic suspension. From now on, it is the duty of the Election Commission (EC) because it has examined the qualifications of the candidates until the election process is complete. Mr. Chan came in first in the votes.
