Mr. Phumtham Wechayachai, Deputy Prime Minister and Minister of Commerce, as a core leader of the Pheu Thai Party, talked about the election of the president of the Pathum Thani Provincial Administrative Organization, in which Mr. Chan Phuangphet, the Pheu Thai Party candidate who won the election, was found guilty by the NACC and likely to be ordered to stop performing his duties, saying that there should not be any problems. The court has accepted the case. However, during the time that the case was filed, Mr. Chan had already stopped performing his duties, so there was no order to stop performing his duties. As for the circular letter in which the Council of State gave its opinion on the case, he thought that it was
a legal opinion. However, whether Mr. Chan will be ordered to stop performing his duties or not depends on the justice process, which is the duty of the court only.
Mr. Phumtham confirmed that he has not automatically stopped his duties as people were worried about. It is a new matter and a new agenda for action. He believes that Mr. Chan still has the right to perform his duties as the provincial administrative organization president because when he applied with the Pheu Thai Party, he did not lack qualifications. It is a process that the selection team has already screened. He himself is not aware because he is not in the party for a long time. This matter will be left to the justice process. He emphasized that there has been no order from the court yet.
However, according to the NACC law, Section 98 and 81, it is not clear enough. We must wait for the court’s order only. The NACC has a duty to accept the case for consideration. There is a process for checking and making a decision. If the court orders th
at the case is guilty, it means that the case is definitely over. This case is still in the process of accepting the lawsuit. Please understand the justice process that when someone is arrested and prosecuted, the law considers them innocent. It must be clearly proven that they are guilty. Please do not worry and do not think too far. You must live with the truth. Let the court consider first.
As for the case where the Council of State gave its opinion that even if he returned to perform his duties, if the justice process was not clear, he would have to stop performing his duties, Mr. Phumtham said that it was only the opinion of the Council of State, but he still had to wait for the opinion of the court. There were many matters that were the opinion of the Council of State, but the court could decide otherwise. Therefore, the court’s discretion must not be violated.
When asked about the case of Mr. Chan, who already knew that he was in a case and would prolong the court’s consideration, whether it would ha
ve a negative impact on the administration of Pathum Thani Province, Mr. Phumtham said that he did not know whether there would be a suspension of duties or not. If this matter was a fantasy, the justice process must be allowed to perform its duties. In this case, if it were decided by itself, it would seem that the court’s discretion might be violated. Whatever the court orders, it must be carried out accordingly.
This is a normal thing in Thai society. Before the election, there will be criticism. After the election, there will be a poll to measure popularity. It is better to wait for the correct process. There is no need to blame anyone for harassing anyone or reviving the case. If we adhere to the law and the justice process, everyone can relax. Mr. Chan is not yet in a position where he must stop performing his duties because the Election Commission considered it when he applied for the position of Provincial Administrative Organization president. He has not yet been found guilty, so he has the right to
