The National Anti-Corruption Commission (NACC) organized the activity ‘Discussion Project to Listen to Opinions on the Selection and Qualifications of the NACC Committee According to the Constitution of the Kingdom of Thailand B.E. 2560’ by Mr. Niwatchai Kasem Mongkol, Secretary-General of the NACC, reported that in the prevention and suppression of corruption, since the Constitution of the Kingdom of Thailand B.E. 2540 stipulated the establishment of an independent organization under the constitution for the first time, the NACC has the duty and authority to investigate and decide whether government officials are unusually wealthy or commit corruption or commit offenses against their official positions or offenses against their d
uties in the justice system. The performance of the NACC must be independent in order to guarantee the principles of performing duties in giving opinions or considering cases. Therefore, the constitution stipulates a process for selecting individuals to serve as NACC members through the selection process and through the selection committee to be submitted to the Senate for consideration and approval.
The NACC Secretary-General also said that the current Constitution of the Kingdom of Thailand 2017 still has the same selection method, but it was found that the selection process for the NACC, which will guarantee that those who enter must be knowledgeable, experienced, have proven achievements, and are honest, still encounters problems in proposing names of qualified individuals in some cases, such as individuals who are selected must be knowledgeable, skilled, and have expertise, which may be proposed from a group of individuals from various professions, such as individuals from adjudicating organizations or
executives from government agencies, state enterprises, or other state agencies, or individuals in professions supported by laws, or groups with knowledge and expertise in management, finance, treasury, accounting, or enterprise management. There are still problems in terms of qualifications regarding the calculation of length of service in various positions, and the requirement that the selection committee members have the same qualifications as those in the organization that must be selected. As a result, independent organizations have problems with selecting representatives to be selection committee members, including performing duties on the selection committee in approving individuals to hold positions on the NACC, but such individuals have not received approval from the Senate, causing the selection process for the NACC to take longer than the law stipulates, resulting in a lack of continuity in performing duties. This is the origin of today’s event to listen to opinions from various sectors to consider
appropriate procedures and raise the standards of those who perform their duties in accordance with the intent of the law.
Pol. Gen. Watcharapol Prasarnrajkit, the chairman of the NACC, gave an opening speech saying that he has been in the position for 8 years and 9 months. The NACC’s work is based on a majority vote of 5 votes. However, since there are only 7 NACC members left, the credibility of the decision is quite a problem. Therefore, it is expected that there will be 9 members who are qualified, knowledgeable, and have proven honesty in order for the NACC to perform its duties fairly, because this is an important matter. Furthermore, the process of amending the constitution may lead to amendments to the qualifications of the NACC members and the Organic Act on the Prevention and Promotion of Corruption.
